At Tu Casa En Espana we aim to make the selling or buying of your new home as seamless as possible. Our legal and tax partners will ensure efficient and professional service at a low cost all inclusive fee with no hidden extras or surprises.

 

You may already have legal and tax advisors and you are welcome to instruct your own legal team, Tu Casa En Espana are happy to liaise with your existing lawyers to ensure a smooth as possible sale or purchase.

 

This is the scope of the legal and tax services we can offer:

Drafting of the purchase contract between the buyer and yourself (seller)

Assisting you in completing the sale of your property at the Notary

Cancelling all the direct debits

 

Other requirements that will need to be taken into consideration for the completion of your sale:

 

You may have to pay Plusvalia tax in cases where you are selling with a profit. The value of this tax depends on how many years you have owned the property and the valuation of the council tax)

You will need to have all of your utilities up to date until the day of completion. If you don’t have the utilities up to date or connected, the buyers’ solicitor will need to retain funds to reconnect all the utilities or to pay off the debts.

If the property has a mortgage, we will need to cancel it on the day of completion. The amount that you owe to the bank will be deducted from the banker’s draft that you will receive. The buyer solicitor will retain money for the Land Registry and Notary in order to cancel the mortgage deeds.

You will need to provide the buyers’ solicitor with up-to-date Habitation and Energy Certificates. We can assist you in obtaining those certificates.

If the property has had any alterations or extensions, such as a swimming pool, garage, or extra bedrooms, they will need to be registered before completion or on the day of completion. We will arrange an architect’s Certificate, and this fee will be retained, or you will have to pay for it as well as the Notary, Land Registry, and 1.5% of the valuation of the new build.

You will also need to ask for a Community Certificate stating that the Community fees are paid up to date. We can assist you in obtaining that certificate.

Purchase deeds from when you bought the property Utility Bills (water, electricity, gas, council tax) Habitation certificate and Energy Certificate. As stated above, we can assist you in obtaining those certificates.
